1.2 This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with the Services, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

If there is any inconsistency between this Privacy Policy and the Terms and Conditions in relation to the handling of personal information, this Privacy Policy prevails.

1.5 This Privacy Policy is directed at Members, Visitors and members of the public who interact with the Services. It does not apply to information we hold about our own officers or employees in the course of their employment, which is generally exempt from the Privacy Act 1988 (Cth) under the “employee records” exemption, and is instead handled under our internal human resources policies and employment arrangements.

2.1 The personal information we collect depends on how you interact with the Services, and may include:

social media interactions – such as comments, messages, likes or follows on our social media accounts, to the extent made available to us by the relevant platform
2.2 Where you discuss a Client case within the Bodyworkers University community, our Terms and Conditions require you to de-identify the Client unless you have their consent to share identifying information. We do not intend to collect identifiable Client information through the community, and any such information is provided by Members at their own responsibility and subject to our Terms and Conditions.
2.3 We do not knowingly collect sensitive information (such as health information) about individuals who are not our Members, except to the limited extent a Member chooses to include such information in a de-identified case discussion, or where a Member has represented to us that they hold the necessary consent.
3. How We Collect Personal Information
3.1 We generally collect personal information directly from you, including when you: create an account or Membership; browse or use the Website; purchase a Membership; post or interact within the community; contact our support, billing or complaints channels; follow, message, or comment on our social media accounts; or otherwise provide information to us.
3.2 We may also collect personal information from third parties, including our payment processor, the Skool platform, social media platforms, and analytics or marketing service providers, to the extent those third parties share information with us in connection with your use of the Services.
3.3 Where practicable, we collect personal information only directly from the individual concerned. If we receive personal information about you from a third party (for example, information shared by another Member about you), we will take reasonable steps to ensure you are made aware of this Privacy Policy.
4. Why We Collect, Use and Disclose Personal Information
4.1 We collect, hold, use and disclose personal information for purposes including to:
create and administer your account and Membership
process payments, subscriptions, renewals and refunds
provide, operate, personalise and improve the Services, including course content and community features
communicate with you, including responding to enquiries, support requests and complaints
send you administrative and service-related communications (such as billing notices or changes to these policies)
with your consent or as otherwise permitted by law, send you marketing communications about courses, offers or events, which you may opt out of at any time
moderate the community and social media accounts, and enforce our Terms and Conditions
maintain the security and integrity of the Website and Services, and prevent fraud or misuse
comply with our legal obligations, and to establish, exercise or defend legal claims
4.2 We will only use or disclose personal information for another purpose where you would reasonably expect us to do so, where you have consented, or where otherwise permitted or required by law.

6.3 Where you post Member Content, comments or case discussions within the community, that Content may be visible to other Members, and, in the case of public social media posts or comments, to the public, in accordance with our Terms and Conditions.
7. Overseas Disclosure and Storage
7.1 Some of our service providers (including the Skool platform, cloud hosting providers, payment processors, and analytics or marketing platforms) may store or process personal information on servers located outside Australia, including in the United States or other countries where those providers operate.
7.2 Before disclosing personal information to an overseas recipient, we will take reasonable steps, as required by Australian Privacy Principle 8, to ensure that the overseas recipient handles the information in a manner consistent with the Australian Privacy Principles, including by relying on the service provider's own privacy and security commitments, contractual protections, or applicable data protection frameworks such as the EU/UK GDPR where relevant.
7.3 By using the Services, you acknowledge that your personal information may be handled by service providers located outside Australia, in accordance with this clause.

8.1 With your consent, or otherwise in accordance with the law, we may send you marketing communications about Bodyworkers University courses, content, offers or events by email or other means.
8.2 You may opt out of receiving direct marketing communications at any time by using the unsubscribe link in the relevant communication, or by contacting us at info@bodyworkersuniversity.com. We will action your request within a reasonable time.
8.3 You will continue to receive necessary administrative and service-related communications (such as billing notices) even if you opt out of marketing communications, for as long as you hold a Membership.
9. Data Security
9.1 We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure, including through the use of secure hosting, access controls, and reputable third-party service providers.
9.2 No method of electronic storage or transmission is completely secure. While we take reasonable steps to protect personal information, we cannot guarantee its absolute security.
9.3 If we become aware of a data breach that is likely to result in serious harm to affected individuals, we will comply with our obligations under the Notifiable Data Breaches scheme in the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.
